Dermly operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Dermly is powered by Shopify, which enables us to provide the Services to you.

The following Terms of Service (the "Terms") describe your rights and responsibilities when you use our Services. Please read them carefully before using our website or placing an order.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you should not use our Services. Individual results may vary, and no specific outcome is guaranteed for any individual beyond the terms expressly stated in our Refund Policy. If you are unsure whether a skin growth is a skin tag, consult a healthcare professional before use. Do not use our products on moles, warts, birthmarks, or suspicious, irritated, or changing lesions. Do not use on broken, infected, or inflamed skin.

You are solely responsible for reading and following the instructions included with the product. Use of the product other than as directed in the included instructions constitutes misuse, and Dermly shall not be responsible for any outcome resulting from misuse, including use on growths other than common benign skin tags, use on children, or failure to follow the application steps described in the instruction manual.

We reserve the right to modify, discontinue, or replace any product at any time without notice, and to limit product quantities or refuse sales on a case-by-case basis at our sole discretion.

SECTION 3 - ORDERS AND ORDER ACCEPTANCE

When you place an order, you are making an offer to purchase. An order is not accepted until we confirm shipment. We reserve the right, at our sole discretion, to refuse, limit, or cancel any order for any reason, including but not limited to: suspected fraud or unauthorized activity, errors in pricing or product information, unavailability of stock, orders that appear to be placed by resellers or bots, or violations of these Terms. If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

All purchases are subject to our Refund & Return Policy, which is incorporated into these Terms by reference.

SECTION 4 - PRICES, PROMOTIONS AND BILLING

All prices are listed in U.S. dollars unless otherwise stated. Prices, discounts, and promotions are subject to change at any time without notice. Promotional offers, discount codes, and free-gift promotions are valid only for the period and conditions stated, cannot be combined unless expressly indicated, have no cash value, and may be modified or withdrawn by us at any time. We reserve the right to cancel orders that abuse or exploit a promotion, pricing error, or discount code.

You agree to provide accurate, current billing and payment information for all purchases. You authorize us and our payment processors to charge your selected payment method for your order total, including shipping charges and applicable taxes. If a payment is declined, reversed, or disputed, we may suspend or cancel the associated order.

SECTION 5 - SHIPPING AND DELIVERY

Shipping and delivery times displayed at checkout or on our website are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, weather conditions, holidays, or events outside our reasonable control.

If your order is lost in transit or arrives damaged, contact us at dermlyskin@gmail.com and we will work with the carrier to resolve the issue and make it right with a replacement or refund, in accordance with our Refund & Return Policy. Claims for lost or damaged shipments must be reported to us within a reasonable time of the expected delivery date so that we can open a carrier investigation.

Orders returned to us by the carrier as undeliverable due to an incorrect address provided by the customer, or due to the customer's failure to collect the package, may be refunded minus the original shipping costs, or reshipped at the customer's expense.

SECTION 6 - INTELLECTUAL PROPERTY

All content on this website — including the Dermly name, logos, branding, graphics, text, product descriptions, images, videos, page layouts, and marketing materials — is the property of Dermly or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, copy, distribute, republish, scrape, frame, or commercially exploit any content from our Services without our prior written permission. Nothing in these Terms grants you any license or right to use any Dermly trademark, product name, or content except as necessary to browse the store and place orders for personal use.

Dermly is powered by Shopify, which enables us to provide our Services. However, all purchases made through this store are made directly with Dermly and not with Shopify. Shopify is not a party to any transaction between you and Dermly and is not responsible for any aspect of such transactions.

Your submission of personal information through the store is governed by our Privacy Policy, which is incorporated into these Terms by reference.

SECTION 10 - CUSTOMER CONTENT, REVIEWS AND FEEDBACK

To the fullest extent permitted by law, in no event shall Dermly's total aggregate liability for any claim arising out of or relating to these Terms, the Services, or any product exceed the amount you actually paid to Dermly for the product giving rise to the claim.

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.

SECTION 16 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Dermly, Shopify, and their respective affiliates, officers, employees, contractors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your misuse of the Services or any product, including use contrary to the included instructions or the intended-use limitations in Section 2; or (c) your violation of any law or the rights of any third party.

SECTION 17 - DISPUTE RESOLUTION; INFORMAL RESOLUTION FIRST

We want to resolve any issue you have quickly and fairly. Before filing any formal claim, you agree to first contact us at dermlyskin@gmail.com with a description of the issue and give us thirty (30) days to work with you toward an informal resolution. Most concerns can be resolved this way.

If a dispute is not resolved informally, you and Dermly agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any product shall be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer arbitration rules, rather than in court, except that either party may bring an individual claim in small claims court where jurisdictionally permitted. The arbitration shall take place in the State of California or, where required by the applicable rules, in your county of residence, and may be conducted remotely.

Class Action Waiver: You and Dermly agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

If this arbitration agreement or the class action waiver is found unenforceable as to a particular claim, that claim shall proceed in the courts identified in Section 18, and the remainder of this section shall continue to apply to all other claims.

SECTION 18 - GOVERNING LAW AND VENUE

These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Subject to Section 17, any claims not subject to arbitration shall be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of such courts.

SECTION 19 - FORCE MAJEURE

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, labor disputes, carrier or supplier failures, governmental actions, or interruptions of internet or payment infrastructure.

SECTION 20 - SEVERABILITY, WAIVER AND ASSIGNMENT

If any provision of these Terms is found unlawful or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets; you may not assign your rights under these Terms without our written consent.

SECTION 21 - ENTIRE AGREEMENT

These Terms, together with our Refund & Return Policy, Privacy Policy, and any other policies posted on our website, constitute the entire agreement between you and Dermly regarding the use of the Services and supersede any prior agreements or understandings.

We reserve the right to modify these Terms at any time by updating this page. The "Last updated" date at the top of this page indicates when these Terms were last revised. Changes take effect upon posting. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
